Terms of Service

These terms govern your use of AgentsPoppy (agentspoppy.com) and the apps we operate ourselves, including MailPoppy. By using them, you agree to these terms.

1. Who we are

The service is provided by Olly Digital, established in Amsterdam, the Netherlands (registered with the Dutch Chamber of Commerce, KvK no. 68745532). You can reach us at support@agentspoppy.com.

2. What AgentsPoppy is

AgentsPoppy is a marketplace and toolkit for small apps ("poppies") that run inside your own cloud account (for example, your AWS account). Some poppies are made and operated by us ("first-party apps", such as MailPoppy); others are made by independent developers ("third-party poppies"). A poppy only ever gets the scoped, least-privilege, revocable access to your cloud account that you approve, and you can pause or remove it at any time.

3. Your cloud account is yours

Poppies operate in your own cloud account, on your instruction. You own that account and are responsible for it, including any charges your cloud provider bills you for the resources created there. We are not your cloud provider and are not responsible for those costs. We design poppies to be least-privilege and fully removable, but the account and what runs in it remain under your control.

4. Your account with us

You are responsible for providing accurate information and for keeping your sign-in credentials secure. You must be able to form a binding contract to use the service.

5. Payments

  • Prices, currency and any applicable taxes (such as VAT) are shown at checkout. Payments are processed by Stripe.
  • Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from the billing portal; access continues until the end of the period you have already paid for, and is not renewed after that.
  • One-time purchases grant what they unlock without recurring charges.
  • Refunds & withdrawal. If you are a consumer in the EU, you have a 14-day right of withdrawal for distance purchases. Because our products are digital services that begin immediately, by starting to use a purchase you ask us to begin at once and acknowledge you lose that withdrawal right once the service has been fully provided. Beyond your statutory rights, fees already charged for a service that has been provided are non-refundable. Nothing here limits mandatory consumer-protection rights you have under Dutch or EU law.
  • First-party vs third-party. For first-party apps, Olly Digital is the seller and merchant of record. For third-party poppies, the independent developer is the seller and merchant of record; we act only as a payment facilitator and charge the developer a platform fee. Support and refunds for a third-party purchase are governed by that developer's terms.

6. If you publish a poppy

Publishing is governed in full by the Developer Agreement, accepted when you create a developer account. In short, if you list a poppy you agree that:

  • you have the right to distribute what you publish, and it does not infringe others' rights or break the law;
  • you are the seller and merchant of record for your sales, you set your price, and we retain a platform fee on sales made through our checkout;
  • your poppy follows our developer rules — least-privilege access scoped to resources it creates, no malware, honest disclosure, and no steering users to external payment to unlock features; and
  • we may review, decline, or remove a listing that breaks these terms or puts users at risk.

7. Acceptable use

Don't use the service unlawfully, don't abuse or attempt to break it, don't interfere with other users, and don't attempt to clone or resell the platform itself. Our software components are licensed under their stated licenses (for example, the AgentsPoppy host and SDK under the PolyForm Perimeter License 1.0.0); those licenses govern that code.

8. Intellectual property

The AgentsPoppy name, brand and platform are ours. Content and configuration you create remain yours. Each third-party poppy's intellectual property belongs to its developer.

9. Third-party poppies

Third-party poppies are provided by independent developers, not by us. We curate the directory and enforce baseline safety rules, but we don't control those apps and don't warrant them. Your use of a third-party poppy is between you and its developer.

10. Disclaimers & liability

The service is provided "as is", and we don't guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law, Olly Digital is not liable for indirect or consequential loss, for charges billed by your own cloud provider, for data held in your own cloud account, or for third-party poppies. Nothing in these terms excludes liability that cannot be excluded by law, and if you are a consumer, your mandatory statutory rights are unaffected.

11. Termination

You can stop using the service at any time. We may suspend or end access if these terms are breached or where necessary to protect users or comply with the law.

12. Changes

We may update the service and these terms; the "last updated" date above reflects the current version, and we'll flag material changes where we can.

13. Governing law

These terms are governed by the law of the Netherlands, and disputes fall under the jurisdiction of the courts of Amsterdam. If you are a consumer, you keep the protection of mandatory provisions of the law of your country of residence.
